Divorce Reform Act

On August 15, 2010 the Governor  of New York signed into law the 2010 divorce reform act.  The highlights are

  • That it immediately allows a spouse to obtain a divorce just by saying the marriage has been irretrievably broken down at least six months. This is not rebuttable. Thus there is no more need to prove grounds for divorce on the basis of fault in ny state.
  •  Also the law sets a formula for setting temporary maintenance obligations and sets requirements for temporary counsel fees and expert fees.
