On August 15, 2010, the Governor of New York signed into law the 2010 divorce reform act. The highlights are:
- That it immediately allows a spouse to obtain a divorce just by saying the marriage has been irretrievably broken down for at least six months. This is not rebuttable. Thus, there is no more need to prove grounds for divorce on the basis of fault in New York State.
- Also, the law sets a formula for setting temporary maintenance obligations and sets requirements for temporary counsel fees and expert fees.
You should consult with counsel about how this new law affects you.
